American Duchess is committed to collecting, using, sharing and protecting your personal information responsibly. We will only keep or share personal information when necessary to deliver the quality of service you rightfully expect.

This Privacy Policy describes how your personal information is collected, used, shared and protected when you (the "User") visit or make a purchase from www.americanduchess.com (the “Site”).
 

Personal information we collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We may also capture personal identification information from you when you fill out a form, email us, or telephone us. You may be asked for, as appropriate, your name, email address, mailing address, phone number, credit card information.
 

How do we use your personal information?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to communicate with you, screen our orders for potential risk or fraud; and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

    We may use your browsing history on our Site in order to display banner adverts or other promotional content for our products on other websites.
     

Sharing your personal information

We do not sell or trade your Personal Information with third parties, but we may share Personal Information with third-parties to help us better manage our Site, improve services, or to facilitate payment transactions, such as:

We use your choice of Authorize.net or PayPal to process payments and will share Order Information in order to facilitate financial transactions. We may also share Personal Information and/or Device Information to Authorize.net in order to effectively screen for fraudulent activity.

We use Google Analytics to help us understand how our customers use the Site

We share Personal Information with MailChimp if you have opted in to our email newsletter. This is limited to first name, last name, and email address unless you provide additional information to MailChimp directly.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information we receive, or to otherwise protect our rights.
 

Mobile Terms of Service

The American Duchess mobile message service (the "Service") is operated by American Duchess (“American Duchess”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to American Duchess’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of American Duchess through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with American Duchess. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18336810729 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other American Duchess mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

How we protect your personal information

Our website is PCI compliant and is scanned on a regular basis for security issues and known vulnerabilities in order to make your visit to our site as safe as possible.

Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Transport Layer Security (TLS), which supersedes and is considered more secure than Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information.

All charge and refund transactions are processed through your choice of either Authorize.net or PayPal and are not stored or processed on our servers.
 

Behavioral advertising

As described above, we may use your Personal Information, Order Information and/or Device Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Do not track

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
 

Data retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. For security reasons, we do not retain credit card or other payment information once a payment transaction has completed; however, this information may be stored by the third-party payment processor (Authorize.net or PayPal) with who we have shared this information.
 

Your right to be forgotten

We will honor any request to delete all of your Personal Information and/or Device Information that has been retained. Please note that this usually exceeds the scope of GDPR and will result in the deletion of any account(s) held by you, all order history, and may impact our ability to provide customer service, returns and/or warranty support for products. Please email info@americanduchess.com with your request and it will be processed promptly.
 

California Online Privacy Protection Act

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law's reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared. - See more at consumercal.org

According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously.
  • Once this privacy policy is created, we will add a link to it on our homepage or as a minimum, on the first significant page after entering our website.
  • Our Privacy Policy link includes the word 'Privacy' and can easily be found on the page specified above.

Children Online Privacy Act

When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

We do not specifically market to children under the age of 13 years old.
 

Resident rights within the European Union

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe.
